Eligibility: This project is open only to those who signed up at the project website(s) and/or social media platforms and who are 18 years and older as of the date of entry. If you have received a gift, prize or won anything from our studio in the past 18 months, or taken advantage of another Bokeh Creatives offer, special, or promotion within the past 18 months, you are not eligible to win and if you book an appointment you will not qualify to receive any free product offered. The project is only open to legal residents of United States, and is void where prohibited by law.
Agreement to Rules: By participating, the Applicant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Bokeh Creatives as final and binding as it relates to the content of this Project.
Campaign Period: Applications will be accepted online. All applications must be received during the period the project is being run - selected applicants will be notified immediately and have 5 days to respond to claim their spot or the spot will be offered to the next in line.
How to Enter: The project must be entered by submitting an entry using the online form provided online and/or at project website(s) and/or social media platforms. The entry must fulfill all requirements, as specified, to be eligible to be selected. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Bokeh Creatives. You may apply only once. You must provide the information requested. You may not apply multiple times by using multiple email addresses, identities, or devices in an attempt to circumvent the rules. If You use fraudulent methods or otherwise attempt to circumvent the rules, your submission may be removed from eligibility at the sole discretion of Bokeh Creatives.
Prizes: If multiple participants are to be selected, those selected will receive a Portrait Session in Studio at Bokeh Creatives and specified size Artwork/print for your home as specified in the project (framing is not included) - and/or the specified value of artwork as listed in the promo and selection announcement. If a promotion includes a Grand Prize Winner, they will be selected after the year's end on January 1.
No cash or other gift substitution shall be permitted except at Bokeh Creatives discretion. The gift is non transferable. Any and all gift-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of selected participant(s). No substitution of gift or transfer/assignment of gift to others or request for the cash equivalent by those selected is permitted. Acceptance of gift constitutes permission for Bokeh Creatives to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Participation: Projects are specifically set to allow those selected to do a walk-in without any money out of pocket by calling the studio on the First or Third Thursday of the month within 30 days of being selected. Simply leave a voicemail between 8am and 9am stating you are available that day. If we have openings remaining, we will call you back and let you know what time you can come in. A deposit of $249 will be held to reserve a date/time in the calendar.
If you prefer to plan ahead and book a date in our calendar, we have created an exception to our normal booking fee of $500 for project participants. You may self book online or over the phone with our staff by choosing any available date/time from our calendar and providing a non-refundable date reservation fee to hold a date/time so that no one else make take the slot, even our full-paying clients, ensuring you are able to get a slot even if our walk-in slots entirely fill.Terms & Conditions specifics: Bokeh Creatives reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the project should virus, pandemic, bug, non-authorized human intervention, fraud, or other cause beyond Bokeh Creatives control affect the administration, security, fairness, or proper conduct of the project. In such case, Bokeh Creatives may select the participants from all eligible applications received prior to and/or after (if appropriate) the action taken by Bokeh Creatives. Bokeh Creatives reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the project or website or violates these Terms & Conditions. Bokeh Creatives has the right, in its sole discretion, to maintain the integrity of the projects, to void entries for any reason, including, but not limited to: multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by project rules; or the use of bots, macros, scripts, or other technical means for entering. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the project may be a violation of criminal and civil laws. Should such attempt be made, Bokeh Creatives reserves the right to seek damages to the fullest extent permitted by law.
Limitation of Liability: By applying, You agree to release and hold harmless Bokeh Creatives and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the project and/or his/her acceptance, possession, use, or misuse of any gift or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the application process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.
Disputes: THIS project IS GOVERNED BY THE LAWS OF United States AND California, specific to Placer County and any dispute must be handled inside of Placer County, Roseville, California, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this project, YOU agree that any and all disputes that cannot be resolved between the parties, and causes of action out of or connected with this project, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Placer County, California having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with applying to this project). Applicant further waives all rights to have damages multiplied or increased.
Privacy Policy: Bokeh Creatives will NOT sell your information provided in your entry.
Sponsor: The Sponsor of the project is Bokeh Creatives.
Facebook/Instagram: The project hosted by Bokeh Creatives is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.
Our artists reserve exclusive studio time to provide you with our very best, personalized one-on-one service while we create your artwork. We require more than 10 days notice to reschedule your portrait session, otherwise a rescheduling fee of $200 will be required. Cancellations are not refundable. Arriving more than 10 minutes late counts as a cancellation.
Taxes & fees: Participant/applicant is responsible for any/all taxes or fees associated with receiving the gift given. For grand prize winners, you will be sent appropriate tax forms for your gift’s value and you will be responsible for all associated taxes.
Finished Artwork Delivery: Gifted artwork is delivered within 2-6 weeks to the winner's home address. Custom pieces delivered as scheduled.
All decision makers (spouse, partner, significant other) should be present for both the portrait commission and the artwork ordering session. If all decision makers are not able to be present, the deposit will be forfeit and the prize will be forfeit.
Ordering Appointment: This single visit is the opportunity to choose participant’s artwork. Options to enlarge your portrait or choose a higher-end finish at additional fees will be presented to those selected at time of the ordering appointment, as well as framing options. Any decisions must be made at time of visit and cannot be extended to a later time.
Portrait artwork available for purchase at Bokeh Creatives ranges in price from $500 to $20,000.
Framing may be purchased through Bokeh Creatives - any artwork framed by Bokeh Creatives will include a lifetime warranty. Any artwork NOT framed by Bokeh Creatives will include no warranty. Framing is not included with any gift.
Any/all purchasing decisions made by winner during commission and artwork ordering session will be final and cannot be cancelled or changed for any reason.
